Tool Tackle LLC dba Pinch Estimating ("Pinch Estimating," "we," "us," "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information of estimators, applicants, and visitors based in the United States, U.S. Territories, and Canada. By submitting the application form (including via QR code) or otherwise interacting with our services, you acknowledge this Policy and our Terms of Service.

1. Introduction

This Policy applies to information collected through our website, application forms (including forms accessed via QR code), email and SMS communications, and any related services.

2. Information We Collect

  • Identity & Contact: name, business name, email, phone, mailing address, city, state/province, country.
  • Professional: resume, work history, trade specialties, software experience, sample projects, references, certifications, licenses, and insurance documentation (Certificates of Insurance, additional-insured endorsements).
  • Tax & Payment: W-9, W-8BEN, business number, GST/HST registration, banking information needed to issue payment.
  • Compliance: citizenship/residency confirmation, age confirmation, sanctions screening data where required.
  • Technical & Usage: IP address, device, browser type, pages viewed, referring URL, timestamps, and analytics events from our site and tracking pixel (Sender).

3. How We Use Information

  • Evaluate your application and onboard you to our estimator network;
  • Match you to projects based on trade, software, and service area;
  • Process payments and issue tax forms (1099-NEC, T4A-equivalent informational reporting);
  • Verify insurance status, additional-insured endorsements, and license validity;
  • Send transactional, project, and marketing emails and SMS messages;
  • Improve our services, prevent fraud, and comply with legal obligations.

5. How We Share Information

  • Clients: contractors who hire estimators may receive your professional profile and deliverables.
  • Service providers: hosting (Cloudflare, Supabase), email/SMS (Sender, Twilio), analytics, payment processors, accounting, and insurance verification vendors — under confidentiality and data-protection terms.
  • Legal: when required by law, subpoena, or to protect rights, safety, and property.
  • Business transfers: as part of a merger, acquisition, financing, or sale of assets.
  • We do not sell personal information for monetary consideration.

6. Marketing Emails & SMS / Text Messages

When you submit the application form (including via QR code), you consent to receive transactional and marketing emails and SMS/MMS text messages about projects, network updates, tips, and promotions from Pinch Estimating. Message frequency varies. Message and data rates may apply.

  • Email opt-out: click "unsubscribe" in any email.
  • SMS opt-out: reply STOP to any text. Reply HELP for assistance.
  • Communications comply with the U.S. TCPA, CAN-SPAM Act, CTIA guidelines, and Canada's CASL. Quebec residents may exercise rights under Law 25.
  • Withdrawing consent does not affect the lawfulness of processing prior to withdrawal.

7. Cookies & Tracking Technologies

We use cookies, pixels, and similar technologies (including the Sender universal pixel) to operate the site, remember preferences, measure performance, and support marketing. You can control cookies via your browser settings. Disabling cookies may affect functionality.

8. Data Retention

We retain personal information for as long as needed to provide services, enforce our Terms, comply with tax and legal obligations (typically 7 years for U.S. tax records, 6 years under CRA rules), resolve disputes, and maintain backups.

9. Security

We use administrative, technical, and physical safeguards (encryption in transit, role-based access, vendor due diligence). No system is perfectly secure; you use the service at your own risk and should keep credentials confidential.

10. International Data Transfers

Information may be processed in the United States and other countries where our service providers operate. Where required, we use appropriate safeguards (e.g., Standard Contractual Clauses, PIPEDA-compliant agreements).

11. U.S. State Privacy Rights

Residents of California (CCPA/CPRA), Colorado (CPA), Connecticut (CTDPA), Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas (TDPSA), Utah (UCPA), and Virginia (VCDPA) have rights to know, access, correct, delete, and port their personal information, and to opt out of "sale," "sharing," or targeted advertising and certain profiling. To exercise rights, email privacy@pinchestimating.com. We will not discriminate against you for exercising these rights. California residents have a right to a "Notice at Collection" — the categories above describe what we collect and the purposes; the categories of recipients are described in Section 5.

12. U.S. Territories

Residents of Puerto Rico, U.S. Virgin Islands, Guam, American Samoa, and the Northern Mariana Islands have rights under U.S. federal law and applicable local law (e.g., Puerto Rico Law 111 of 2005 on data security breaches). We will respond to verifiable requests in accordance with those laws.

13. Canadian Privacy Rights (PIPEDA, Law 25, PIPA)

Canadian residents have rights under the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws including Quebec's Law 25, Alberta's PIPA, and British Columbia's PIPA. You may:

  • Access and request correction of your personal information;
  • Withdraw consent (subject to legal/contractual restrictions);
  • Lodge a complaint with the Office of the Privacy Commissioner of Canada or your provincial regulator (CAI in Quebec).
  • Quebec residents have additional rights to data portability, de-indexing, and to be informed of automated decision-making.

Marketing communications comply with CASL. The parties expressly request that this Policy and all related communications be drafted in English (les parties confirment leur volonté que le présent document soit rédigé en anglais).

14. Children

Our services are not directed to individuals under 18. We do not knowingly collect personal information from children.

15. Changes to This Policy

We may update this Policy from time to time. Material changes will be communicated by email or a notice on our site.
